Thank you for your interest in our website. The protection of your privacy is very important to us. Below we inform you in detail about the handling of your data, which is always carried out in compliance with the provisions of data protection law.

1. Responsible body and rights of the person concerned

You can obtain information about your data stored by us free of charge at any time and assert your right to correction, deletion, restriction of the processing of your data or your right to data portability. To do so, please contact the above-mentioned contacts.

If you wish to object to the collection, processing or use of your data by Biogena in accordance with these data protection provisions, either as a whole or for individual measures, you can also send your objection by e-mail, fax or letter to the aforementioned contacts.

You also have the right to lodge a complaint with a supervisory authority if you believe that the processing of personal data concerning you is being carried out unlawfully. You may exercise this right before a supervisory authority in the Member State of your residence, workplace or the place of the alleged infringement.

2. Personal data

Personal data is information about factual or personal circumstances of an identified or identifiable natural person. Statistical data that we collect, for example, when you visit our webshop and that cannot be directly linked to your person are not included here.

Personal data, such as your name, your address, your telephone number, your e-mail address as well as other inventory data, which you disclose to us in the course of your online registration, your order, your newsletter registration as well as your enquiry via our contact form, are collected and processed by us insofar as this is necessary for the processing of your registration or your order, your newsletter registration or the answering of your question.

We collect, store and process your data for the entire duration of the processing of your purchase or your enquiry, including any subsequent warranties, for our services and in accordance with the statutory (in particular tax law) retention periods. Newsletters and electronic advertising will be sent until revoked.

Your data will not be passed on to third parties unless Biogena is entitled or obliged to pass it on for legal reasons. An exception to this is the necessary forwarding of data by Biogena to service providers commissioned with the organisational or technical processing of the order or the execution of deliveries of goods, such as banks, post office or parcel services, insofar as this is necessary for the execution of the delivery of goods. The data passed on in this way may only be used by our service providers to fulfil their task. Any other use of the information is not permitted and does not take place with any of the service providers entrusted by us.

If companies of the Biogena group of companies or commissioned data processors are exceptionally located outside the European Economic Area, care is taken here to ensure an appropriate level of data protection and compliance with the relevant data protection requirements. There are no plans to transfer data to a third country beyond this.

The processing purposes in detail:

2.1 Online registration in our webshop

Purchases in our webshop as well as the use of our product memo list are possible after successful online registration in our Biogena Club (for consumers) or our partner area (for doctors and therapists).

Your online access is password protected. Here you can view data on your completed, open and recently dispatched orders and manage your collected loyalty points, your personal data and any newsletter registration.

You undertake to treat the personal access data confidentially and not to make it accessible to any unauthorised third party. We cannot accept any liability for misused passwords unless we are responsible for the misuse. Please note that you will automatically remain logged in unless you log out.

2.2 Purchase processing

By completing your online order, you expressly allow us to process the personal data you have provided for the purpose of processing your purchase and sending your order. We need your e-mail address so that we can confirm receipt of your order. We also use this for your identification (web log-in). Furthermore, you will receive your order and shipping confirmation via your e-mail address. We also need your e-mail address and telephone number in order to be able to communicate with you in the event of queries regarding your order or delivery problems.

2.2.1 Customer survey - we need your feedback

In the course of your order of Biogena preparations, you will receive an invitation to participate in a voluntary customer survey 4 weeks after your purchase, from which you can unsubscribe at any time with effect for the future. The data obtained from this survey is analysed anonymously and represents important feedback to enable us to tailor our products even more closely to the needs of our consumers and to support our scientific team.

2.3 Newsletter registration / receipt of electronic advertising

By confirming your newsletter registration, you voluntarily agree that the following companies of the Biogena group of companies may process the data you have provided for the purpose of sending you electronic newsletters and receiving electronic direct mailings and personal advertisements about Biogena products and events and services: Biogena GmbH & Co KG, Nolimits Digital Business GmbH, Biogena Diagnostics Österreich GmbH, Biogena Diagnostics Deutschland GmbH. Personalised advertising means advertising tailored to you and your interests. We use existing information, such as your region of residence, your registration date and the customer group to which you belong (consumer or doctor or therapist), in order to only send you advertising for products that could actually be of interest to you.

Registration for the Biogena newsletter (newsletter of Biogena GmbH & Co KG) only takes place if you have actively consented to receive it. We use the so-called double opt-in procedure for sending the newsletter, i.e. we will only send you a newsletter by e-mail if you have previously expressly confirmed that you want us to activate the newsletter service. We will then send you a notification e-mail and ask you to confirm that you would like to receive our newsletter by clicking on a link contained in this e-mail.

Should you later no longer wish to receive newsletters from us, you can object to receiving them at any time free of charge. A message in text form (e.g. e-mail, fax, letter) to the contacts listed under point 1 is sufficient for this purpose. Of course, you will also find an unsubscribe link in every newsletter.

2.4 Inquiry via contact form

If you send us an enquiry via the contact form, the personal data you provide will be processed by Biogena solely for the purpose of dealing with your request and - if necessary to answer your enquiry - forwarded to the relevant company of the Biogena group of companies.

Since enquiries via contact forms can be of various types, we require at least the information from you that is defined as mandatory fields in the contact form.

3. Server log data

When you visit our website, log data, which does not allow us to draw any conclusions about your person, is automatically logged and temporarily stored. This data includes, for example, browser type and version, referrer URL, shortened IP address, provider name and operating system used. All log data is analysed anonymously by us or by the service provider commissioned by us exclusively for statistical purposes, to improve our offer, to facilitate troubleshooting and to defend against attacks on our web shop.

4. Cookies

In order to make our website user-friendly (web analysis) and to enable the use of certain functions, such as our web shop or the product memo list, we use cookies in some areas.

Cookies are small files that are stored locally on your data carrier and save certain settings and data for exchange with our system via your browser.

Most of the cookies we use are session cookies and are deleted from your hard drive after you close your browser. The long-term cookies we use remain stored on your hard drive for 30 days and are then deleted. When you visit us again, we will automatically recognise that you have already been to our website and which entries and settings you prefer.

By using our website, you declare that you expressly wish to use our web service and, insofar as cookies are accepted according to your browser settings, you agree to the use of these cookies. Most browsers are set by default to accept all cookies. However, you have the option of setting your browser in such a way that cookies are displayed before they are stored, only certain cookies are accepted or rejected, or cookies are generally rejected or deleted.

We would like to point out that changes to settings only ever affect the browser in question. If you use different browsers or change the end device, the settings must be made again. Furthermore, you can delete cookies from your storage medium at any time. 5. Google Analytics and Google AdWords

This website uses Google Analytics, a web analytics service provided by Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (Google). The use includes the Universal Analytics mode of operation. Google Analytics uses so-called cookies.

On behalf of the website operator, Google will use the information generated by the cookies to evaluate your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage. Our legitimate interest in data processing also lies in these purposes. The legal basis for the use of Google Analytics is Art. 6 para. 1 lit. f DSGVO. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. However, we would like to point out that this website uses Google Analytics with the extension ""anonymizeIP"" and therefore IP addresses are only processed in abbreviated form in order to exclude direct personal reference. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and shortened there. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

The data sent by us and linked to cookies, user IDs (e.g. user ID) or advertising IDs are automatically deleted after 14 months. Data whose retention period has been reached is automatically deleted once a month.

We also use the online advertising programme ""Google AdWords"" and, as part of Google AdWords, Google's conversion tracking. When you click on an ad placed by Google, a cookie for conversion tracking is stored on your computer. These cookies lose their validity after 30 days, do not contain any personal data and are therefore not used for personal identification.

If you visit certain web pages on our website and the cookie has not yet expired, Google and we will be able to recognise that you have clicked on the ad and have been redirected to this page. Each Google AdWords customer receives a different cookie. Thus, there is no way that cookies can be tracked across AdWords customers' websites. The information obtained using the conversion cookie is used to create conversion statistics for AdWords customers who have opted in to conversion tracking. Here, the customers only learn the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users.

If you do not wish to participate in tracking, you can object to this use by preventing the installation of cookies through a corresponding setting in your browser software (deactivation option).

Likewise, you can generally prevent the storage of cookies by setting your browser software accordingly; however, we would like to point out repeatedly that in this case you may not be able to use all the functions of this website to their full extent. 6. Digital analytics tools

With your consent, our website uses the analytics tool Hotjar. This allows us to track the actions of users on our website after they have accepted the cookie banner. This enables us to constantly improve and develop our customer journey.

The data collected remains anonymous. This means that we cannot see the personal data of individual users. However, the collected data is stored and processed by Hotjar. We will inform you about this matter according to our current information.

Only users over the age of 16 are allowed to give their permission. If you are under 16, please contact your legal guardian.

For the possibility of deactivating cookies on our website, see point 4. Hotjar itself stores the IP address of the user anonymously. To do this, it only collects the first 3 eight-bit characters of the IP in order to be able to determine the visitor's country. Hotjar does not store the remaining characters. In addition, Hotjar claims to store all the data obtained on servers in Ireland. This means that the data is located in the EU, so that website operators can comply with the requirements of the General Data Protection Regulation (GDPR).

7. Facebook Pixel / Remarketing / Retargeting

With your consent, our website uses the conversion tracking pixel service of Facebook, Inc, 1601 S. California Ave, Palo Alto, CA 94304, USA (""Facebook""). This allows us to track the actions of users after they have been redirected to a provider website by clicking on a Facebook advertisement. This enables us to record the effectiveness of Facebook ads for statistical and market research purposes.

The data collected remains anonymous. This means that we cannot look into the personal data of individual users. However, the collected data will be stored and processed by Facebook. We will inform you about this matter according to our current information. Facebook may link the data to your Facebook account data and use the data for its own advertising purposes, according to Facebook's data policy https://www.facebook.com/about/privacy/. Facebook conversion tracking also allows Facebook and its partners to show you ads inside and outside of Facebook. In addition, a cookie is stored on your computer for these purposes.

Remarketing tags of the social network Facebook, 1601 South California Avenue, Palo Alto, CA 94304, USA are also integrated on our website. When you visit our pages, the remarketing tags establish a direct connection between your browser and the Facebook server. Facebook thereby receives the information that you have visited our site with your IP address. This enables Facebook to assign the visit to our pages to your user account. We can use the information obtained in this way to display Facebook ads. We would like to point out that we, as the provider of the pages, have no knowledge of the content of the transmitted data or its use by Facebook. 8. Social media plug-ins

Our website uses social plug-ins (""plug-ins"") of the social network facebook.com, which is operated by Facebook Inc, 1601 S. California Ave, Palo Alto, CA 94304, USA (""Facebook""). 9 Use of MyFonts

The design of our website also uses external fonts for display, which are provided by the company MyFonts Inc, 600 Unicorn Park Drive, Woburn, MA 01801, USA (hereinafter: MyFonts). These fonts are integrated by means of a server call at MyFonts. In order to deliver the font files to your browser, at least your IP address is transmitted to a MyFonts server when you access our website. In addition, further information (e.g. name of the website called up, date and time of the request, type of web browser used) may be transmitted to MyFonts. To prevent the execution of Java Script codes from MyFonts, you can deactivate Java Script in your browser or install a Java Script blocker (e.g. http://www.noscript.net or https://www.ghostery.com/). 10. Data security

The security of your data is very important to us. All personal data requested by us is transmitted in encrypted form via a secure SSL connection so that it is protected from unauthorised access. In addition, we take further technical and organisational security precautions to prevent the loss, destruction and misuse of data. You should always keep your access information confidential and close the browser window when you have finished communicating with us, especially if you share the computer with others. The personal data and information you provide will be protected against unauthorised access by third parties with the greatest possible care. We will take all reasonable steps to ensure the security of personal data. However, it is pointed out to the customer that the World Wide Web is accessible worldwide and, in particular, that misuse cannot be ruled out, so that unauthorised access by third parties to such data and information cannot be ruled out even despite the greatest possible care.

11. Conditions of participation in social media competitions

Social media competitions (in particular on Facebook) are organised by Biogena GmbH & Co KG, Strubergasse 24, 5020 Salzburg (hereinafter: ""Biogena""). Participation in competitions is only possible under the conditions listed here. By participating, the participant expressly accepts these conditions of participation:

  1. Sweepstakes are not affiliated with Facebook and are in no way sponsored, endorsed or organised by Facebook. The recipient of the information provided by the participant is not Facebook, but Biogena as operator of the ""Biogena GmbH & Co KG"" Facebook page and organiser of the competition. The information provided will only be used for the competition.
  2. Please refer to the respective competition post for the start and end dates (implementation period) of the competition.
  3. The prizes to be won are those defined in the competition post. Exchange, cash redemption and legal action are excluded. As a rule, the prizes will be sent by post.
  4. Voluntary participation in the competition takes place via a comment (picture or text) on our Facebook post on a competition and/or Like. Multiple comments from the same user will be counted as a single entry.
  5. Persons residing in Austria or Germany who are at least 18 years old at the time of entry and who are fans of Biogena GmbH & Co KG on Facebook are eligible to enter. You become such a fan by clicking the ""Like"" button on the ""Biogena GmbH & Co KG"" Facebook page. Employees, authorised representatives, legal successors and agents of Biogena GmbH & Co KG, involved agencies and their relatives are not eligible to participate.
  6. The draw for the prize will take place after the end of the implementation period, excluding the public and guaranteeing the principle of chance. Participation in the prize draw requires a comment or like.
  7. The winner will be informed via the Facebook comment function of the Facebook post on Facebook or via Facebook Messenger. The winner must report their contact and address details by private message to the ""Biogena GmbH & Co KG"" Facebook page or by email to [email protected] within 5 working days (from notification of winning). If winners do not confirm acceptance of the prize within this time, their claim to the prize will be forfeited without compensation. A replacement winner will then be determined using the same procedure. There is no obligation to accept the prize.
  8. Comments that violate the Facebook guidelines, Austrian law, our netiquette and/or copyright will be removed without notice after becoming known. The participant is thus excluded from the prize draw.
  9. The organiser reserves the right to cancel or terminate the prize draw at any time without prior notice and without giving reasons. The legal process is excluded.
  10. Insofar as personal data of participants is collected within the scope of the prize draw, this data will be collected, processed and used by the organiser exclusively for the purpose of conducting the prize draw and will be deleted after the prize draw has ended. The participant is responsible for the correctness and completeness of his/her submitted data.

12. Notice on video surveillance

The foyer of the Biogena company headquarters at Strubergasse 24, 5020 Salzburg, as well as the entrance and sales areas of the Biogena stores are subject to video surveillance for the preventive protection of persons and objects against vandalism and acts punishable by law. The following companies are responsible for this:

The image data obtained will only be stored for a period of 72 hours. Image data will only be stored for longer than 72 hours if this is necessary to pursue legal claims. A transfer to other recipients is not permitted. The data is stored on a network hard drive. The data evaluation is password-protected and only takes place when necessary.
